As a landlord it is inevitable that one day you will be dealing with a tenant who just does not comply with the rules and therefore must be evicted from the property. 1) Do it yourself: This is the cheapest solution if done right and the most expensive one if done wrong and unfortunately it is very easy to do an eviction wrong! You better make sure to understand all rights and obligations of both landlord and tenant during the eviction process. Whatever you do, do not resort to illegal selfhelp methods like locking out the tenant, turning off utilities, intimidation or putting the tenants belongings on the street because these actions will be severely punished at the eviction court. Unfortunately many people try to do an eviction themselves to then resort to one of the methods below after making some major mistakes.
2) Hire an attorney: Getting proper legal advice to do the eviction the right way is definitely a better choice than the DIY method, but there are some important pitfalls to watch out for. First of all, you want to make sure that you hire an attorney that has done evictions before, you do not want your case to be study material for someone that is unexperienced in this matter. Second, you will want to hire an attorney that is specialized in real estate and not in a total different area of law. Third, you will want to have an idea in advance about the total cost for the legal advice. One way to do this is to negotiate a flat fee that does not allow for an overrun. We once bought a house from a lady that had spent $8600 in legal fees to do an eviction before she called us to buy her property! Make sure to also account for costs other then legal fees such as holding costs, lost rent (evictions can take several months), repairs and a cleanup after the property has been vacated (tenants facing eviction will typically cause a lot of damage).
3) Sell to an investor that is comfortable with buying a house with a tenant in it that needs to be evicted. This is no different from selling a car that needs some work to a car dealership. It will be the fastest method to get out of the situation and you will not have to do deal with the tenant, attorneys, eviction court and contractors to repair the house.
